
1. These terms and conditions of business
are between Brockhouse Limited T/A the catering agency (hereinafter
called the company) and the hirer hiring the Temporary and/or contract
Worker (hereinafter called the client).
2. These terms and conditions of business
are deemed to be accepted by the client by virtue of an interview or
engagement by the client of a temporary and/or contract worker introduced
by the company.
3. Charges which largely represent remuneration
paid are invoiced weekly and are payable within 14 days of the company
invoice. The company reserves the right to charge interest on any outstanding
moneys out of our Terms of Business (14 days).
4. The rate of interest is the official
dealing rate of the Bank of England (base rate) + 8%, as stated by 'The
Late Payment of Commercial Debts (Interest) Act 1998'.
5. Payment of all Invoices is to be made
to Redd Factors Ltd, The Business Centre, Brimpton Lane, Brimpton Reading
RG7 4TN.
6. The company reserves the right to
withdraw service at any time without notice or reason.
7. The company assumes responsibility
for payment of remuneration, deduction and payment of all statutory
contributions where applicable.
8. The engagement or use by a client
(in any 6 month period) of a temporary/ permanent worker or a former
temporary/permanent worker introduced by the company whether for a definite
or indefinite period, or the introduction of such temporary worker to
other employers with a resulting engagement, renders the client subject
to the payment of a introduction fee as set out below. The introduction
fee (for any worker engaged in employment as set out in point 8) is
12% of the first years salary or £900.00p which ever is the greater
amount, payable within 14 days of engagement. Failure to inform the
company of the engagement will render the client an extra fee of £450.00p
payable within 14 days of engagement.
9. The Client will have claw back rights
(see claw back document) on any introduction fee.
10. The rights of claw back are forfeited
if the client fails to inform the company of the engagement, or if the
client breaks our terms of business.
11. The company assumes responsibility
for the training of all temporary workers in current legislation regarding
Health and Hygiene (Food).
12. The Client acknowledges that the
Company does not have the obligation to supervise, direct or control
the manner, time or place of any Worker's work. The Client acknowledges
that the Company's charges reflect this.
13. The client is responsible for following
all current legislation regarding Employment and Health and Safety in
the working environment.
14. The minimum booking time is 4 hours,
per person, per session.
15. As per the 'THE EMPLOYMENT AGENCIES
ACT 1973' the company can not supply workers to a client/hirer as direct
replacements of employees who are in a industrial dispute with the hirer
(only if a trade union is involved).
16. The Company must adhere to' The Employment
Agencies Act 1973'.
17. The Company my change these Terms
of Business with 7 days notice in writing.
18. No liability will be accepted by
the company for any loss, injury, damage, expense or delay directly
or indirectly from or in any way connected with any failure by the company
to supply a temporary worker or act by any temporary worker supplied
by the company.
19. The Client acknowledges that the
limitations and exclusions of the obligations and liabilities of the
Company set out herein are reasonable and reflected in the charges payable
to the Company hereunder, and shall accept risk and/or insure accordingly.
20. This agreement is to be governed
by and construed in all respects in accordance with the Laws of England
and Wales.
21. No variation can be made to these
terms without the written consent of the Directors.
